1. Acceptance of terms

These Terms & Conditions (“Terms”) govern your access to and use of the Hooklink website and application (the “Service”) operated by Hooklink (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

• You must be at least 18 years old and able to form a binding contract.
• To use the automation features you must own or be authorised to manage an Instagram professional (Business or Creator) account linked to a Facebook Page.
• You are responsible for ensuring your use of the Service complies with Instagram's and Meta's terms and policies.

3. The Service

Hooklink lets you build automations that respond to Instagram comments, story replies, mentions and direct messages using Meta's official APIs. Features include AutoDM delivery, public comment replies, lead collection and follower-growth tools, with delivery designed to respect Meta's rate limits and messaging windows.

We may add, modify or discontinue features at any time. We rely on third-party platforms (notably Meta and Razorpay), and changes to those platforms may affect the Service.

4. Your account

• You are responsible for the activity that occurs under your account and for keeping your sign-in method secure.
• You must provide accurate information and keep it up to date.
• Notify us promptly of any unauthorised use of your account.

5. Instagram connection & platform compliance

When you connect an Instagram account you authorise Hooklink to act on your behalf via Meta's APIs to operate the automations you configure. You remain responsible for your account and its compliance with Meta's terms.

• We use only official Meta APIs and do not perform actions that violate Instagram's terms (such as automating likes or follows, or scraping).
• Meta may change, limit or revoke API access at any time, which can interrupt the Service.
• We are not affiliated with, endorsed by, or sponsored by Meta or Instagram.

6. Acceptable use

You agree not to use the Service to:

• Send spam, unsolicited bulk messages, or content that is unlawful, deceptive, harassing, hateful or infringing.
• Violate Instagram's, Meta's or any third party's terms, rights or policies.
• Attempt to bypass rate limits, security controls or access restrictions, or to reverse-engineer the Service.
• Resell or provide the Service to third parties without our written permission.

We may suspend or terminate accounts that we reasonably believe violate these Terms or put the Service or other users at risk.

7. Plans, billing & payments

• Hooklink offers a free plan and paid “Pro” plans. Current pricing is shown in the app and may change with notice.
• Paid subscriptions are billed in advance on a recurring basis (for example monthly or yearly) through Razorpay, including UPI Autopay where supported.
• Subscriptions renew automatically until cancelled. You can cancel anytime from Settings → Billing; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable. If you believe you were charged in error, contact support and we will review it in good faith.
• Taxes may apply and will be charged in addition to the displayed price where applicable.

8. Referral programme

If you participate in the referral programme, you may earn a percentage of the qualifying subscription charges of users you refer, subject to programme rules shown in the app. Earnings can be withdrawn once they reach the stated minimum and are paid manually to the details you provide. We may withhold or reverse earnings obtained through fraud, self-referral or abuse, and we may modify or end the programme at any time.

9. Intellectual property

The Service, including its software, design, branding and content (excluding your content and Instagram data), is owned by Hooklink and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

10. Your content and data

You retain ownership of the content and data you provide or that your automations process. You grant us a limited licence to host, process and transmit that content as necessary to provide the Service. You are responsible for ensuring you have the rights and permissions needed for the messages and data you process through the Service.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee any particular results, including follower growth, leads, deliverability, or uninterrupted access.

You acknowledge that automated engagement carries inherent platform risk and that Meta may restrict or suspend accounts. Hooklink is not responsible for actions Meta takes against your Instagram account.

12. Limitation of liability

To the maximum extent permitted by law, Hooklink and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or Instagram account access. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the three months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold Hooklink harmless from any claims, damages, liabilities and expenses arising out of your use of the Service, your content, or your violation of these Terms or any third-party rights or platform policies.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by a third-party platform, or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive (such as payment obligations, disclaimers and limitations of liability) will survive.

15. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.

16. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in India will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service, subject to any applicable mandatory consumer-protection laws.
